A few days ago my boyfriend got into a crash.
While driving, a driver in the on-coming traffic lane crossed over the line and side swiped his 1990 Ford Ranger. It ripped off his mirror, dented his door, ripped off his running board, popped his tire, and bent his rear axel. He had slammed his breaks and his truck slid almost 100 yards. My boyfriend had no insurance, but the other drive did.
After the wreck, I brought my boyfriend to the hospital. He got blunt force trauma to his stomach and muscle strain. He has missed 3 days of work so far.
We went to a lawyer and she said she will represent him to gain a vehicle, medical expenses, and lost wages.
What I am wanting to know is if the case can be won, if so how much could he win? We live in Tennessee if that matters, I’m not sure if laws differ state to state.
Any help will be greatly appreciated.
The other driver was driving without contacts in and also on a suspended license due to a previous wreck. I’m not sure if this could help with the case or not.

No one can tell you that answer. I can tell you they will pay for repairs or if the vehicle is totaled fair market value of your vehicle in your area. They will recover medical expenses. Depending on civil tort law in Tennessee there is a maximum amount, but no one can know what the judge will determine is reasonable under compensatory law. The fact the other driver was under suspension has nothing to do with your BF’s case, that is a matter for the police if they choose to charge him and send it up to the DA. Besides don’t get greedy. You said your BF was driving uninsured, it is unlawful to operate a motor vehicle with out insurance. What if he had been the one to swerve and hit someone and caused property and physical damage. He doesn’t even have and insurance Company to sue.

It could be a substantial amount, but this is a question to be asking the lawyer, not a bunch of Yahoo answer people.

The amount he would win would depend on his medical bills and the amount of damage to his car. IF he won the other person would probably just have to cover the cost of the medical bills and his car but honestly since your bf was driving without insurance (which is illegal) I dont think he has to good of a chance to win? but thats just my opinion, good luck to him! I hope he does win cause the other guy should have been more careful!

the fact that the driver was driving without contacts and with a suspended license can better ur case and the fact that ur bf was injured. the only problem is that ur bf didnt have insurance and that might cost u because u will have to pay everything out of ur pocket and then sue to the driver for all ur loses. also, u and ur bf might not get that much money due to the fact that he didnt have insurance…

Appearing from your facts, the other driver is at fault. In case you win, your boyfriend would be compensated for all expenses he incurred in treating his injuries or in repairing his damaged truck. Of course, all receipts must be accounted for to prevent invalid expenses.
