I got into a hit and run accident 5 weeks ago. I didnt see the van but it hit me and my baby one the side and threw me into 2 other cars. One in which was a cadillac escalade. Anyways to make a long story short my car was totaled and the baby was okay in the end. As for myself i suffered a dislocated hip, back pain and some other minor injuries. So anyways there were witnesses that saw the accident and knew the guy. It just so happen it was a company vehicle and the detectives caught up with him later. They called me and gave me his name and company phone number. Now my problem is my lawyer sent him a letter requesting his insurance company, but the owner refuses. My lawyer told me if he doesnt get his insurance company in 10 days then they will drop my case. Also i cant file it on my insurance because it had lapsed 2 days before the accident. (i know thats bad) but im still a victim in this accident. So does anyone know how i can find out his insurance company. My lawyers are lazy.
I already called and asked. He says he doesnt want to give it to me.
I got a police report, but since it was a hit and run accident it wasnt on there. Later when they caught up with this guy the detectives called me and just gave me then phone number.

Do I get another lawyer?

I was in a car accident before I turned 18. I was the passenger. My medical bills added up to about 00 JUST for the initial treatment. In my state, the statute of limitations ends three years after you turn 18. Because I was so young, and I did not have a ride, I could not go see a doctor for my injuries till about 6 months after my accident. The person who crashed the car had insurance, and they would not cover any of my medical bills. Right after the accident, they offered me a small settlement, but we would not discuss the settlement, and got a laywer right away. He soon dropped my case, saying there were gaps in my treatment (the six months that I could not get to the doctor) and that there was not enough money for him in representing me. I just hired another lawyer, who did the same thing. I am feeling very frustrated, as it is not my fault that I couldn’t go to the doctor. Do I just take the settlement and save myself the effort or try to get a lawyer who will represent me?
Just thought I’d mention:

No, I could seriously not get to a doctor. I was 16, I did not have a car or driver, and at the time we lost our house and our car.

In all honesty? No! I could not get to a doctor.

Do I need a lawyer for injuries (fractured sternum)?

Recently I was involved in a head on collision and suffered a fractured sternum. The accident was not my fault, and I was a passenger. My car’s driver was not at fault. However, the other driver left the scene. My driver has insurance, but we are not sure if the other driver has insurance. He had left the scene.

I went to the E.R. (Via Ambulance) and was given CT scan and Rx.s then sent home within 4hours. I have already been to a follow up appointment, every thing seems ok. I have some soreness and have limited movement with my upper body. I have already gotten a leave of absence from my job.

The doctor says that I will be well in about 8 weeks, and if I want, I can return to work. I do not have any pain anywhere else (like neck, back, legs) I did for the first few days, but now the pain is just where fracture is.

Do I need to go see another doctor, because I saw somewhere, of course on the net, that I need to go to an orthopedic specialist for a full report to turn in towards the claim. Is this true? Or will the follow up and E.R. documentation be enough.

Also, from a personal point of view, I’d like to go to a specialist to see if my injuries are improving (post -"follow up" exam). Would the insurance or lawyers allow and additional visit. (would they pay that extra visit). or not? I have never been in accident. I don’t know how many visits are covered and what do do next?

Days after the accident I received 20 lawyers solicitations in the mail! I did go to one, but haven’t signed anything.

I don’t have a lot of bills, and don’t foresee any future "major" medical bills. I do want to know if I can get "loss of wages". I will be out of work for all of March 2011 and possibly parts of April 2011. (at my current rate of recovery, I see myself working again, by mid April).

I am not a whiner. I’m not trying to win the lottery. I’m a hard worker and would like to get back into the game of life and work. I ain’t Super Girl (I’m taking it easy on my leave), but I want to know if I can get a decent settlement without a lawyer?

There were witness and the other driver was driving the wrong way. It was at night, and the street was not well lit. We were traveling west in the westbound lane, we came around a curve–meanwhile the other car was rounding the same curve- He hit us as he was traveling East in the westbound lane.

My friends involved in the wreck immediately went to a lawyer. (which is fine to me…i don’t know anything about their insurance policy or injuries). They are my friends and I don’t want a lawyer or an adjuster to come between us.

Since they went to one–what will this do to my situation in the accident?

I guess my concern is, what should or should I NOT do as a passenger. I already addressed my injuries in the above paragraph. This is my first (and hopefully) only Accident! Can I get a step by step guide? :)

Insurance company not claiming liability in an accident (yet)?

I was making a left hand turn with a green turn signal and a driver heading the opposite direction ran her red light, did not see my car in the intersection and t-boned my vehicle, totaling it and causing me multiple bodily injuries. She was issued the citation and I also have a witness who stated seeing her run the red light, yet her insurance company is not yet willing to admit liability in the accident.

I am already dealing with the issue on if being a Canadian car insurance company while the accident occurred in Florida. I have a lawyer since I have no comp/collision coverage on my vehicle through my policy so therefore I have to individually seek out their company. I’m also 38 week pregnant.

In cases like this – ticket cited, witness to the fact – and the insurance company is denying liability, what are the chances they’d be able to prove this or will they drop it and just pay up without going to court.
Re-read what I wrote, I stated that I already have a lawyer. I know this is what he does and I shouldn’t worry, but I’m still curious what people’s personal experiences are.
This isn’t the same question as before. I’m inquiring the liability issue, not into Canadian policies in general.

Is this offer for pain and suffering from an automobile accident acceptable?

Hi, I was involved in a motor vehicle collision approximately 4 months ago. I was stopped at a stoplight when I was rear ended by another car traveling 35-40 mph according to the other driver. A police officer witnessed the accident and took the police report. The damage to my car was 00 and the car was totaled. I was reimbursed for the vehicle and rental fees already. I experienced lower back and neck pain 2-3 days later after the accident. The next business day I went to a chiropractor. I went to therapy for 3 months 3 times per week. I was originally in a lot of pain, but the pain turned into manageable discomfort over time and didn’t make any progress after that. The doctor told me I was ready to be discharged from therapy. I recently got an offer from the insurance company. They offered to pay for my medical bills just shy of 00, and offered 00 for pain and suffering. I felt this was an unreasonable offer for pain and suffering. I feel the pain I endured that was caused by this accident, the inconvenience this whole ordeal has had (pain, time to and from therapy, fuel, etc.), in conjunction with future back problems I may develop is worth more than 00. I told the adjuster how I felt and was offered a couple hundred dollars more. They told me that is all they could offer me because it was a soft tissue injury and that is how much a jury would award me. I didn’t originally hire a lawyer because I didn’t want to wait forever to get a higher sum only to have to turn around and pay the difference to the lawyer making it about the same amount net to me. What can I do? Should I get a lawyer? Any advice, recommendations, or help you can provide would be greatly appreciated. The Location is Oklahoma and the insurance company is Farmers. I thought I would include that in case there were any state laws or company policy that may affect anything.

I forgot to mention that when I told the adjuster that i thought the offer was insufficient, the adjuster asked what I had in mind and told me that they could work with me a little. I told the adjuster that I felt an amount equal to the medical bills was acceptable. The adjuster basically said it’s not going to happen and that is when she offered the extra couple hundred dollars and said that is all she could do. The adjuster wouldn’t budge so I told her I would think about it but did not feel it was reasonable and that i may have to consult a lawyer and that i would get back to her.

Can I sue my insurance company for ignoring me?

I was in an severe accident a month ago, and got a personal injury lawyer. It took 5 days for my own insurance adjuster to contact me / my attorney. the adjuster wanted to set up a statement for my mother and i, but my attorney nor i have heard from them since. i’m not allowed to contact my insurance company, yet my attorney calls everyday 2 times, leaves voicemails / messages / etc. the adjuster always seems to be busy or not available. have asked to speak to a supervisor, etc.. my attorney has sent faxes / certified letters and still continues to this day… i understand there is due diligence but this just seems out of line! Can I sue them for being non cooperative? what i am paying for?

I am Plaintiff and I have a case in the court.
I have my pre Trial is done and on Trial my lawyer and defendent lawyer both mention that where my
accident happen there is speed 80km/hr and defendent driving on 86km/hr
I also saw both Eng. report which one my lawyer make it and also from Defendent lawyer make it
both also mention 80km/hr speed posted there.
Now MY question is that I personally visit many times over the accident location and there is Maximum 70km/hr posted there.

I want to know did the both eng.personally visit on accident scene or they make by computer.
what I have to do to bring the truth.

got rearended few weeks ago and neck starting to hurt.procedures?

got rearended about 2 weeks ago…in state of virginia. 3 car accident. about 700 damages to car. adjuster gave price of 400 dollars. i was a passenger.
hardly no experience in this matter.im hearing all kinds of different stories from different people.
also my neck is getting stiff and starting to hurt/burn sensation a little. i have never been sick besides a cold and really hate hospitals, but if pain dont go away im afraid im gonna have to. plus i cant pay for hospital bill. IF…my neck hurts (2 weeks later) can i somehow claim it on the insurance from accident…im hearing many stories from many different people..some wanting me to go get checked out and see a personal injury lawyer..some saying accident wasnt bad enough for my injuries. im hoping my neck heals and wont have to worry about hospital.
what the best way to approach this thing without me getting screwed later on.from what i heard if the person accepts the adjuster quote, it waives my rights of filing suit on insurance , from what i heard. if my neck pain was caused from accident then im really screwd
help please

personal injury case?

i was in a car accident and injured my neck and back i will need surgery for lower back but am waiting the insurance company have admitted liability and are paying for treatments including all medical bills meds and tens unit i have a lawyer but not sureif they are good 2 weeks ago i had a medico legal appointment with the insurance company for phsichiatric assesment and have 1 more appointment with a neurosurgeon in 2 months also from the insurance my lawyer has made me 2 appointments also in 2 months now the first assesment i went to from the insurers side assesed me but have not let out the information to my lawyer and a few days ago i get a call from lawyer saying that the insurance company want to make an offer and also they have closed my case with my occupational therapist also weird could i have been given a high wpi score for them to want settle early or is this normal for them to do i havent ever heard that they settle before being seen by all medico legal doctors and my lawyer hasnt even approached them with a sum that i deserve she wants to wait for me to be assesed by her medico legal doctors any one have a clue could this be a big win for me and their scared they are going to have to pay me a big sum or what do you think please let me know i have permanent injuries i see a phichologist on a weekly basis where the insurance company is also paying for and will need surgery to my lower back but am waiting and depression is severe and i am really scared to drive have 4 young children who are affected from this accident and need alot of help from family with cooking cleaning so on this is a legitamate case because this is my second accident the first one i had was a 3 car collision 9 years ago i got hurt but recovered i didnt even file a claim because i was fine i am a fitness fanatic but getting severely hurt with my second accident has left me with my legs giving way nerves are hitting my spine and neck is protruding also with weekness burning and severe pain pins and needles and painnnnnnnn the doctor wants to have surgery but am too scared to do it but also cant live like this so an answer to my question is do the insurance companys make an offer before being seen by all medico legal doctors because by them approaching my lawyer to make a settlement is really out of the blue thanks
