HELP!!! I was in an auto accident in December 1, 2008. My upper back and neck were seriously injured, although the pain was not felt untill 3+ hours after the accident. Since then I have seen several doctors including : orthopedics, neurologist, chiropractor, and pain management specialist. The pain management doctor diagnosed me with Facet Joint Syndrome and Myofascial Syndrome. He assigned me 3% permanent disabilty in my neck, and also put me on 6 rescriction such as weight limit and work activity etc….. I have been on at least 10 different medications for this. The most recent that have been some what helping are tramadol 50mg 4x a day and soma compound 2x a day. I have been to the ER 2x because the pain was so unbearable. Xrays were taken 2/09 and 9/09. The ones taken in 2/09 showed a possible vertebrae fracture. There was also an MRI taken 3/09 and they said they could not see any fracture on the vertebrae. On the MRI to me it looked like the discs were slightly bulged into the spinal cord but no enough for the radiologist to say anything. He did say there was a mild straightening of the cervical spine which is due to muscle spasms. We do have a lawyer for this as the accident was 100% the other parties fault and also because I have not been able to work for more than 2 months without being in total agony. As some points it gets to a point where the pain killers don’t touch it. The pain has gotten worse over time and it is now not only in my neck but in my upper back and it seems as time goes on it begins to go farther and farther down my back. Is it possible that the doctor has wrongfully diagnosed me? If so what do you think it could be? Also the lawyer stated that the insurance company is going to want some kind of proof that there is a problem in my back. What kind of medical images would show what is going on in my back? Should I get another MRI because the one that we have no was taken so long ago and the new one could show something that was no visible at that time but has no progressed to a point where it is visible. Also what about a CT/PET scan? Would either one of those help? Please anyone any kind of input. Few months ago, I got in to a messy auto accident and car was totalled and suffered injuries.

Found a lawyer on Yellowpages (one with a large ad) and he seemed thrilled to take the case. Well, after the other party’s insurance denied the claim, he dropped me like a bad habit.

I’ve been calling around to other lawyers (also with large ads) and they seem interested at first but when I tell them about being denied by the insurer, they all say we’ll call you back after discussing it with our lawyers and then never do. Some even ask for photos of the accident and after I email them they never call back.

So am I getting the "brush off"?

Or should I call them back and ask what’s up?

I am currently taking tramadol now. I have seen bone doctors but not specifally a spinal doctor. I guess that will be my next step. I talked to my doctor today and they ordered the MRI and hopefully that will show something. I will try to load some pics of my MRI on here and see what people have to say.

ok, we were in a car accident couple days ago.We were in a busy road and she was going to turn into the lot and i was coming down on the road and she turned and i hit her.I had no way of stopping because i was to close and was going on 40.We took all the info and she had a heart problem so they called the ambulance for her.The officer at the scene told me that she was at fault because she should have waited until u went by.So i called her insurance company and guess what no insurance.I called her to tell her that and she said that i am at fault and she says that she has hired a lawyer to sue me.Can she do that?What can i do?please any advice would be great.We still don’t have the police report ,because it takes like 5 days.But i am 100% sure shes at fault.

In an auto accident. Lawyer wants a description of what I am dealing with which is constant pain,life style changes, might lose my cleaning business,hard to care for my home. I have 3 herniated disks as a result of being rear ended.

My father has a shop (auto body business) that caught on fire due to an employee’s accident. Not all of the shop burned down but a good portion of the shop burned so he could not assume work for about 3months and counting to this day. The insurance company that covers such accidents only paid him a tiny fraction of the losses- which is supposed to include all property that was lost from the fire (computer, equipment, structural damage) plus atleast 3 months of loss of income which adds up to quite a bit.
He recently received a letter saying that the very meager claims payment he received is all he will get. I’m not sure by detail exactly why it happened this way but how do we fight this case? Should we hire a lawyer? What can he do? This is ruining his finances. please help!

I was involved in a hit-and-run two years ago. I was sitting behind a stopped car waiting to turn left, and was rear-ended by a Jeep going well over the speed limit. I was 6 months pregnant at the time. The guy fled the scene, but I took his license plate and knew him because he was my neighbor. I went to the hospital because the baby became real active, and I bruised my hips and the back of my head. They didn’t really do anything for me, but checked out the baby and everything turned out fine. My car was totaled and my back hurt. I had later went to doctors for orthopedic and obstetrician care which PIP paid for, nothing too serious. I obtained a lawyer immediately. They caught the guy two weeks later and charged him. Turns out he was driving on revoked license. My lawyer tried to settle with Geico (my insurance). They uninsured driver’s wife had Maryland Auto Insurance Fund which is car insurance for driver’s with bad driving records. Geico offered 00, then 00. After about a year, my lawyer gave my account to another lawyer. I had to go through the whole spiel, telling them what happened and all. After a year with them, Geico has offered 00, and now 00 for pain and suffering. Whatever I settle on, my lawyer gets 33.13%. My lawyer and Geico adjuster are playing phone tag. I’m not happy w/my lawyer because they never call me to inform me of anything…I have to. I was pregnant during the accident and couldn’t enjoy the remainder of my pregnancy because of fear something might not be right with my baby…my previous was a miscarriage. I couldn’t get the right care (x-rays, cat scans, etc.) because of the baby coming first. The problem here is that I didn’t ask for this lawyer and want better results. The lawyer keeps talking me out of settling for 00, promising he can get me more. The thing is if he files suit, no matter what their 33.13% goes to 40%. Should I settle or move on to another lawyer, and if I do settle, would I have to pay the previous lawyer?

I was in a car accident december 20th and got injured. My auto insurance policy said they cover up to 15,000$ in injuries for this case. I have spent on medical bills etc…already 14,000$. If I go over 15,000$, am I going to lose money from my settlement? I asked my lawyer and she said I might and she will call me and get back to me, but my lawyer is always busy and never calls me back, I’ve tried getting in contact with her for the past week and she is always too busy. So does anyone know if i will lose money off my settlement?
