Can a Release of All Claims Form be disputed?

Posted in automobile accident lawyer on 20.01.11

My friend was injured in an automobile accident by the airbag. The airbag deployed as designed, but it caused total blindness in her left eye. Her lawyer had her sign this form so he could get paid by the other driver’s insurance. She received k out of 0k. The lawyer and hospital got the rest. She is blind in her left eye because of the airbag. Does this form release the other driver of further litigation? And does this form prevent Toyota from being sued? Can Toyota be sued if the airbag deployed as was designed? It is an older car. A 1997 Toyota Camry.

How Much Can I Claim?

Posted in automobile accident lawyer on 15.12.10

I suffered an accident at a major retail chain about 5 weeks ago. What happened was I was told by the store associate to bring a car battery to the counter so I could buy it. The batter spewed battery acid on my chest causing 1st degree burns on my chest. I also inhaled it causing Acute Brochospasming, which posed quite a bit of discomfort. What I’ve also come to find out, the while I know the contents of an automobile battery is HIGHLY TOXIC, inhalation can cause larynx cancer. Not only did I inhale the battery acid, it also was absorbed into my skin.

I am a cancer survivor and the thought of battling cancer later on due to this sends chills down my spine. Of course, this accident was of no fault of my own.

The manufacturer of the battery is requesting my claim. I spoke to a lawyer and he estimated my medical bills at around 00 (Urgent Care, then an ER visit when things didn’t rectify, then F/U visit with my Doctor). However, the lawyer was wrong, and the bills have totalled ,023. I have the bills and the totals.

What I am wondering is what seems like a good amount of money to claim for the ‘pain and suffering’ part of all of this??? Keep in mind, I have been exposed to a cancer causing toxin and have already battled cancer in my lifetime. While I am now feeling better, I now deal with the worry and possibility of battling cancer. Some have said ,000, some have said ,000, some have said ,000 and some have said ,000.

Any ideas? Please advise.

Thank you.
The lawyer already advised me to ‘aim high’. Because I am better, he said I don’t have a lawsuit, unless they deny my claim….and right now, I am just collecting paperwork in regard.

In FL if I am not listed on an issured automobile insurance but living with them am i covered?

Posted in automobile accident lawyer on 25.11.10

I have received conflicting stories. I live with my parents and was their vehicle. I do not have auto insurance for myself or a vehicle. I got in an accident and now the insurance company is saying they will not cover it because I am listed as a driver on my father’s policy. I was told by several different people including a lawyer that I am covered as long as I am living in the house and do not have auto insurance myself? Can anyone help?
I am not a named issurer on my dad’s policy.
Ok so I have a typo on my question. I am NOT on an auto policy. But it does seem to make a difference because he did not list me on his policy.

My kneecap was broken in a car accident. How much should i ask for in compensation besides medical bills?

Posted in automobile accident lawyer on 04.10.10

On July 30th I was injured in an automobile accident. It was the other drivers fault and my kneecap was broken. Their insurance company said they will cover my medical bills and lost wages. I was off work for a month and on crouches with a kneebrace. I am back at work and still have to wear the kneebrace. The doctor says the long term effects would be that I will develop arthritis in my knee later in life. I don’t want to get a lawyer because I don’t trust them and don’t want them taking the majority of my settlement. I was just wondering how much I should settle for besides my medical bills and lost wages. I’m refering to pain and sufferring and overall inconvenience. Can anyone help me? I don’t plan on settling until the doctor clears me of any more treatment. Another question is since I have quit taking the pain meds I have noticed a pain in my elbow that was not there before the accident. Is it to late to have this covered as well?

Did McCain crash more than planes ?

Posted in automobile accident lawyer on 12.09.10

For the past two months, a major American magazine and an allied news service have been engaged in a legal battle with the United States Navy over records that they believe show that John McCain once was involved in an automobile accident that injured or, perhaps, killed another individual.

Vanity Fair magazine and the National Security News Service claim to have knowledge "developed from first-hand sources" of a car crash that involved then-Lt. McCain at the main gate of a Virginia naval base in 1964, according to legal filings. The incident has been largely, if not entirely, kept from the public. And in documents suing the Navy to release pertinent information, lawyers for the NS News Service allege that a cover-up may be at play.

"Plaintiffs have also obtained documents showing that law enforcement officers were ordered back to the accident scene to retrieve personal physical effects. The Navy has never publicly acknowledged this information," one document reads. "This request involves federal government activity, as it addresses what may be an attempt by the Navy to protect by concealment the involvement of a former Navy officer, sitting Senator and Presidential candidate in a serious incident involving the injury or death of another human being."

The first request for information concerning duty assignment logs to Portsmouth Naval Hospital — where McCain was allegedly brought after the accident — came in the form of a Freedom of Information Act request on August 28, 2008. The Navy acknowledged receipt of the request and advised that it had located the relevant information a few weeks later, only to deny the FOIA on grounds that it didn’t prove an "imminent threat to the life or physical safety of an individual" or satisfy the criteria of "a breaking news story of general public interest."

"The patient admission record logs that you seek are exempt from release," wrote G.E. Lattin, Deputy Assistant Judge Advocate General, "as information in personnel and medical files, as well as similar personal information in other files, that if disclosed to a requestor, other than the actual person in which the information is pertaining to or next of kin, would constitute a clearly unwarranted invasion of personal privacy."

NS News Service and Vanity Fair appealed the decision and asked for expedited treatment of the case, as the end of the presidential election loomed. But the Navy denied that request as well.

"It appears to be a deliberate refusal to provide clearly releasable information concerning assignments to Portsmouth Naval Hospital," wrote legal representatives for the two news organizations. "Allowing the Navy to extend its time to respond beyond a date when the documentary facts of this matter would be available for public consideration prior to the national election on Tuesday, November 4, 2008 would violate the spirit, as well as the provisions of the FOIA."

Staff for National Security News Service and the company’s lawyer both refused to discuss the proceedings. And there are only parcels of information concerning the story that can be gleamed from the court documents.

At a minimum it seems clear that Vanity Fair and NS News Service have launched an investigation "disclosing first-hand witnesses’ recollection of an automobile accident in which then Lt. John S. McCain III was involved. Those witnesses specifically recall McCain’s assignment to that [hospital] facility with the other person involved in the accident." This episode in McCain’s life has, it seems, not been made public, and the plaintiffs suggest that the Navy may be attempting to actively restrict information about the incident.

"The subject matter of the documents is a matter of current exigency to the American public," reads a document filed by legal representatives for the news service, "because the requester is preparing a current news report addressing whether the Navy continues to conceal the involvement of a Navy officer in a serious automobile accident in July 1964."

Injured in an automobile accident 4 years ago and still NO settlement!! HELP!!?

Posted in automobile accident lawyer on 10.09.10

Four years ago on Decemeber 17th, I was injured in an automobile accident. My stopped car was hit by a semi-truck hauling pipe and pushed 150 yards up the road. I was lucky. I came out of the accident with nerve damage to my right arm. All my doctors advise no surgery will correct the damage, just to live with what I have been dealt. A bit easier said than done. I was pregnant when I was in my wreck and have since had a (healthy) baby boy. The only good thing out of 4 years of hell. My husband and I have finacially been knocked to our knees. Going from 2 incomes to one. Making ends meet monthly is a sturrugle beyond belief. I have just had a (federal) disability hearing and am waiting for the verdict (hearing that it is almost impossible to get disability at my age).

I need help with my auto settlement. I hired a larger firm a few months after the accident. They seem to move at snails pace. Is there anything I can do to speed up the process? My lawyers seem not to care. HELP!!
Catz: Yes, they did file last December, so I am in the good with filing. It just seems that everything else is in slow motion. My attorneys allow the trucking companys attorney extensions, they delay depositions. Todya was supposed to be my witnesses depos that were canceled for the 3rd time. And yes, the trucking company had a huge policy, which may be part of the problem. But I am not looking to get rich, I just want paid for my injury. My right arm was injured for life. I think the least of what they owe me should be my lifetime wages.

Facing a felony and detectives did something shady…?

Posted in automobile accident lawyer on 08.09.10

1. Im in court for insurance fruad, my lawyer is telling me to plea guilty. He states 10% i can win in trial.

2. He has hundreds of cases, because he is a court apointed. But he is the best criminal lawyer, money can not buy. For about 33 years.

3. I have a witness talking against me, that lied in the interogating room. ANd while interogating him, he was convering another fraud case he was part off and got confused.

4. He denied, it and later admitted. He got confused on the so called, " paper accidents" He blamed everything on me, and when he was messing up. I hear one detective talking , and then the detectives voice gets cut off ( as if they hit pause) then half of the other detective that was interogating the guy is heard in a half conversation.

5. It was if as , they hit pause and coached him and hit pause again. , when one side of the tape is done, the detives come back state the date, time and continue the interogationg..

6. NOw the dude has his story staright, and is very accurate about everyting. WHen he starts to talk about me, he points his finger and the tape ends.. No detective, states this is the end of this conversation and the interview is over with the RAT.

NOte> This was at the first of the ivestigation on my case, the detectives are known to reward their rats 100% to make them lie.

Now i am stuck with a decision to either plea guilty to Insurance fraud automobile, or bring this to court and fight it… Out come if i loose is bad.. But that Discrepency in the witneses being coached could be attacked in court….. ANY Advice???
i understand, innocent people dont end up in court. But some do, if there pointed at.. With erros cops make, people win their case.

Think about it , as consumers how long are we going to let insurance companies(All) screw us anyway they want?

Posted in automobile accident lawyer on 06.09.10

Even though I pay almost 600.00 a month in the state of Georgia for automobile insurance ( full coverage), I found out if I was in an accident and even though it was not my fault ,a insurance company can charge me with 25% of the accident even though the other driver was ticked for failure to yield, And they are within the law? In this case they are stealing 12,000.00 in damages by just saying Our adjuster see’s it this way contrary to police and eye witnesses statements and oh yea we total led your car.How many of you can relate to begging these insurance companies to charge you a outrageous premium so they can refuse to pay when needed. As consumers we let it go, maybe to proud to admit when ripped off, or maybe boy we’re lucky they didn’t cancel? Another example In Georgia building contractors why even bother getting licensed? I found if Someone was to build a home for example , It happened to me, I paid out 90% of total cost, he completed 50% of the work, and just stole the rest, left a complete mess, but Georgia license’s board can do nothing he put my name as the builder , Even though the home is as now unlivable, BBB will only go after a Business if it’s a member. if you’re unlicensed not a member they can continue without as much as a warning. Lawyers tell me you can sue him but you’ll get a judgment in your favor but no money,,. This is two examples of fraud against a consumers, I’m not perfect by any means but this I will do if you give me a 50.00 bill to buy something for you, if it costs 49.99 I’ll give you the penny back, if it costs 59.99 I’ll pay the difference and say nothing. Honesty, ethical Business behavior is becoming rare in America, as long as it’s legal who cares if we screwed that guy out of his last hope. The two examples I gave, in today’s world people when hearing this story are steadfast those SOB’S should be in jail, but these people I believe are regarded as "good businessman" and in my case honesty will lose every time to the businessman. Contact me or help start a petition against this type unethical slight of hand BS.
