I was in a car accident in December 2006, and my case is still not settled. Why does it all take so long?

Because you hired an attorney and he filed a law suit. That brings the whole settlement process to a grinding halt.
Now you are in litigation. That means discovery and all of the steps that involves.
Law Suits are not fast. Filing a law suit does not speed up a claim.
However, you have an attorney – if a law suit is filed you will probably be paying him 1/2 + expenses of any settlement you get. So…why don’t you ask him – since you are going to be paying him 50%+ of any settlement – ask him.

As a plaintiff in a previous car accident lawsuit, it only took 6 months to settle out of court for me in the state of california, time frame varies from state to state, still yet, this is a long time, depending on what state you are in, my suggestion is to contact your attorney to find out what’s going on, it maybe that you are headed for trial and in this case it takes a long time in most cases, usually the longer it takes to settle, the more money you will recieve, did you do research on the law firm you chose? Insurance adjusters for the opposing company are not your friends, they work for the company you are suing,so, it is logical for them to criticize your actions in getting legal representation to protect your rights. My suggestion is to contact your attorney about the time frame, if you aren’t satisfied with the attorney you have representing you, choose another one that’s reputable and aggressive in winning personal Injury cases, another suggestion is, only deal with a law firm who specializes in Personal Injury, accidents, etc., and, good luck to you, I wish you all the best, I know how stressful it can be having to wait until a lawsuit settles, besure to research your attoney(s) and find out their track record if you have not done this, in the event you choose another, besure he is better than the one(s) you have now. Remember, the attorney works for you , you can not leave every decision for them to make, keep contacting the firm until you get the desired answers you are seeking.
