How long does it take for an attorney to negotiate medical bills for an auto accident case?

My mom was involved in an auto accident in Dec.08. She was pinned between 2 cars and had severe permanent injuries. The other driver was drunk and uninsured. When we signed the retainer with the lawyer we specifically stated that he will only get his 1/3 AFTER all bills has been taken care of. We agreed that he will uses the 20k medical settlement offeree by our insurance to negogiate with medical providers while the remaining 100k of injury settlement will be split between the 2 of us. however, as soon as we signed the settlement release he took his portion right away(,333.00) and left us with (66,……,) saying since medical bills exceeded over 200k there might be a chance that we have to use our part of the settlement to pay for medical providers. It has been about 27 months and we both has gotten our part of the 100k but the separate 20k is still in his hands saying he is still negotiating. Does it usually take this long? is it possible he’s also keeping that portion and ignoring our debt to the medical providers? We are still constantly receiving collection letters. What would happen if it continues to go on unpaid?

    Last first, if it continues to go unpaid the medical providers will sue for the full amount, but if the Lawyer is negotiating they will continue to send statements but will not sue. as for the length of time to negotiate that is impossible to determine if you do not have access to the people who work for the medical providers, it could reach a stalemate and be in limbo for awhile, eventually the providers will write some off and give a final amount they will accept but the time is not possible to calculate.}{

      It all depends on that how strong your case is and how many evidence you are providing there like medical bills, spectator etc. You should be careful in filing the petition don’t put any wrong thing in there otherwise it can go wrong for you. For time it can take almost 6 month for your case.
