ok, we were in a car accident couple days ago.We were in a busy road and she was going to turn into the lot and i was coming down on the road and she turned and i hit her.I had no way of stopping because i was to close and was going on 40.We took all the info and she had a heart problem so they called the ambulance for her.The officer at the scene told me that she was at fault because she should have waited until u went by.So i called her insurance company and guess what no insurance.I called her to tell her that and she said that i am at fault and she says that she has hired a lawyer to sue me.Can she do that?What can i do?please any advice would be great.We still don’t have the police report ,because it takes like 5 days.But i am 100% sure shes at fault.

If she is at fault then you can sue her for your damages. Get an attorney and sue for damages plus legal and court fees……did she get a ticket?

Sure she can sue, but it doesn’t mean she’ll win.
Just call your own insurance company. If you have the right coverages, they’ll cover you for this (minus your deductible) and then pursue her for reimbursement.

as long as the officer put it in his report your good. if not then will have to take him to court with you. talk with your agent and a lawyer if you have one. she can sue you in this crazy world will she win no if you have all the info but more than likely you probably will be going to court

Let them sue you. Based on your description and the fact that the officer deemed it her fault, you are likely to win. Don’t take this on yourself. This is exactly why you have insurance. Call your insurer and report the accident. They will begin a claim to have your car fixed, etc. But don’t mention the potential of a lawsuit yet. Only tell them this when and if you are served with papers and sued. The insurance company will defend you in court since they are on the hook for damages if you lose.
