I got in an accident and the driver at faults insurance only covers $5000, what to do?

I was hit with a truck from the back and pretty much the whole trunk of my car is gone, I had a passenger with me and we both suffer from neck and back and leg injures. The injures are not really bad but bothersome, when the insurance adjuster called me they said that the other driver had coverage of maximum of 00, and I believe the car is totaled and what about the yard storage fees and my medical bill. So what should I do, should I hire a lawyer to get full payment for my car and to injures?

    By all means, find an attorney—TODAY. The attorney will be paid at the end, when all is said and done. The attorney’s services are immeasurable, valuable and will represent YOUR best interest.

    Most drivers pay mandatory uninsured/underinsured coverage on their policies to compensate for the difference in another’s lack of coverage.

    Do NOT accept any money from the insurance UNTIL you get an attorney.

      The $5,000 is for property damage for your vehicle. They should have coverage for your injuries as well.

      If his coverage limits are not acceptable then you can use your under insured motorist coverage if applicable. Medical payments if you have them or collision coverage if needed.

      Worst case you’ll need to file suit against the under insured driver which will likely net you a settlement that doesn’t get paid and a large headache.

        If you have comprehensive and or under insured motorist coverage, let your insurance company handle it. If you don’t have that coverage you will need to accept the money from the other insurance company and sue the driver for the difference. The injuries to you and your passenger do not come from the $5,000.00, The injuries come from the Bodily Injury portion. The $5,000.00 comes from the Property Damage portion.

          Hopefully you have insurance on your car. If so contact your insurance company. They should work for you to get the other party to pay up. That’s part of what you’re paying premiums for.

            Not yet. Hopefully you have uninsured, under insured coverage on your own policy that will make up the difference between what the at fault person carried and your actual expenses. But wait, it’s obvious no one has looked at your car yet since you don’t KNOW that it’s even a total.
