A week ago Sunday I was involved in a car accident in Myrtle Beach. I rear ended a girl in front of me due to her slamming on brakes because two cars in front of her slammed on brakes. (In my car, it was just me and my boyfriend. In the car I ran into, she had three passengers.) After the accident, everyone established that they were absolutely fine. They even told the cop that. Yesterday, my insurance company contacted me to let me know that she turned the incident into her insurance company and two or three of them in her car got attorneys for injuries. So.. what I would like to know is what is going to happen? I believe that means they are going to try and sue my insurance/myself. Has anyone ever been in this situation before? I’m scared and feel very heartbroken. Her car barely had any damage and mine took most of the damage after I had just gotten it painted. Should I get a lawyer? Because none of them were really hurt to have injuries. After the accident, the people in the girl’s car I hit were all standing outside of her car and laughing, having conversation with my boyfriend, so I’m 100% that they were all fine and just want to try and get money by getting attorneys. (My luck :/) Please give me any information or tips that you believe will be helpful.

    Your insurance company will hire a lawyer to defend you. That is why you have insurance. If judgment is entered against you, the insurance company will pay the judgment, up to the policy limits.

      Very common for people to hire attorneys after a car accident. Even people that are not really hurt but decide to get medical treatment thinking they will get a big pay day.

      The insurance companies are used to it. It’s gotten worse with the economic down turn.

      The vast majority of these claims are settled. Very few turn into lawsuits.

      But if it does turn into a law suit, the insurance company will hire an attorney to defend you. If the adjuster thinks a law suit is likely, the adjuster will call you or mail you a letter to give you a heads up.

      If a lawsuit is filed, it gets served on you. You contact your adjuster right away. The adjuster will have you send them the suit papers and will forward them to an attorney to defend you.

      Just make sure you cooperate fully with the insurance company in their investigation. If you move before the claim settles, make sure you call your adjuster and let them know you new phone/address. A claim of this nature could easily take a year or longer to resolve. Just depends on how long the other people treat for.

      Try not to stress out too much about it. If you have not heard from your adjuster, it’s ok to call and just touch base and see what the status of the claim is.
