Best information and tips about injury claim car accident, automobile accident lawyers and personal injuries claim
Awhile ago I was involved in a three car crash. I was traveling east bound and approached an intersection and crossed after it went green. A car traveling north hits my passenger side and spins my car into traffic going west bound and my backend gets hit from on coming traffic. My girlfriend was in the passenger seat when this happened. A witness going southbound calls the police and ambulence for us. After I gave my statement to the officer he lets me go with my girlfriend to the hospital. She gave her statement later at the hospital. Everything was ok until I saw the police report later saying I was at fault because the individual in the third car that my backend hit said I ran the light while she was traveling west bound opposite of me. The person that hits me said he was going on his green. Now I was wondering why thier statements weight more then that of me and my girlfriends when we both stated going on the green. The report didn’t even have the statement of the witness that stopped to call for us because I saw the officer talk to him and wrote his name down. Should I even bother getting an attorney? My girlfriends medical bills total over 000 and she doesn’t have health insurance. Can she sue me? Or am I screwed because the guy that hit me is filing damage claims agaisnt me too. I do have car insurance and have already reported this to them. Thanks in advance for any help.

REALLY getting tired of hearing GET AN ATTORNEY.
You have insurance. Your insurance company will do a complete investigation and determine fault. The fact that two drivers stated that you ran the red ligh, especially the one coming westbound is not goo.
The heavier weight is going to be with the driver westbound as they have nothing to gain by stating you were at fault.
Your girlfriend has a bodily injury claim against you. Your insurance company will handle this for you. If your insurance company thinks you will have a limits problem (damages exceed what you have coverage for) they will notify you.
Good luck

Get an attorney. Some will do free consultations to let you know if you need them or not, but as it sounds you will need one just to cover your own you know what.

The police do not determine who is at fault in an accident. Unless they were there when the accident happened and saw what happened the police’s opinion of fault is no more valid to an insurer than our opinions here. The insurance company(s) determine fault. If they cannot or if you feel that they came to an incorrect conclusion then you can sue the other driver and have a judge declare you 100% not at fault. The problem with accidents in intersections with a stoplight is that unless there is an independent witness (or a red light camera or video surveillance) who can say for sure what happened the other party is always free to say he had the green and you had the red. If that is the story they are presenting to their insurer then there is no way their insurer is going to accept liability and pay your damages. Plus if he has an independent witness (whether a real witness or a suddenly-appeared-out-of-nowhere type) then you’re really in a tight spot. At this point report the accident to your insurer, give them your side of the story and let them work it out. If they still come out with a result that’s not to your liking then you will have to hire a lawyer and sue the other party.
