I'm being sued for a car accident, What do I do?

I was in a minor car accident 3 yrs ago that was my fault. The police were called and a report was filed. At the time the report was filed no one claimed they were hurt, there was only minor damage to our vehicles. My insurance company paid to get his vehicle fixed. Now I’m being sued for emotional damages and loss of wages. Shouldn’t my insurance company handle this? I don’t have alot of money and am just barely scraping by so I can’t afford to pay them and can’t afford a lawyer. What do I do?

    Contact your insurance company. If they already paid on the claim, they would have protected themselves against further action by having the injured party sign something to that effect.

        best bet is to get a lawyer unless, they don’t have one.

          You get sued….the at fault person does not sue your insurance company.

          However, your insurance company will hire an attorney to defend you.

          If you have not notified your insurance company of the law suit….CALL THEM FIRST THING IN THE MORNING.

          When you get served with suit papers, you have 30 days to get an answer on file. If you miss the dead line, it’s a default judgment against you. (not good).

          So, call your insurance company and let them know you got served with suit papers. They will need you to get a copy of the papers to you. They will need to know when you got served and how.

          They will forward the papers to an attorney to defend you per your auto insurance policy. And they will pay the attorney’s bill. The attorney’s office will contact you. You will be expected to participate in the defense of the suit.

          So….yes, your insurance company will handle it….but you have to let them know you got served suit papers and give them the papers in order for them to do so.

            If they are suing for a lot, you NEED a lawyer, or a public defender, which is free.

                no your insurance company should take care of this .Call them ASAP and let them know what is happening.But really if your just getting by like the rest of us ,what can they get out of you .No it sounds like a scam to me.

                  Ordinarily your insurance company will hire you a lawyer. Contact them, they may already know about it.

                    3 years is a long time to take to file a lawsuit. See if the Statute of Limitations doesn’t already preclude the lawsuit. Also, most states don’t allow emotional damages without physical damages. So if there were no physical injuries, then emotional damages might not be possible. Best thing to do is to find a lawyer.

                      Contact your insurance company which provided coverage at a time of this accident., they supposed to defend you and/or to reimburse other party on your behalf. I’m not sure if you can be sued for emotional damages and loss of income. Usually not. However you can be sued for bodily injury.

                        sounds like u need to get a lawyer to defend u
                        so ur lawyer can try to reverse the lawsuit…loss of wages? that would happen if they got hurt badly and stayed in the hospital or something, or if that was their only car nd it was wrecked by u, but they can still use public transportation…… so hopefully u wont have to pay for that
                        Why didn’t they just sue u back then? they just want easy money in times like these..
