Last week my mom was injured in a car accident going through an intersection. Another woman ran a stop sign and dragged my mom’s car into some sort of electrical box or telephone box on someone’s lawn. The police clearly stated my mother wasn’t at fault…etc. SHe has a severly bruised sternum, knee, arm and cheek bone. She was rushed to the hospital..no broken bones thank goodness. My question is does she need to seek a lawyer to fight for any kind of money or will the other insurance company (the woman at fault) pay her? The woman has Geico, and I’ve heard some bad reports about them not paying for claims and what not. So, will my mom need to get a lawyer?

She should sue if the woman refuses to pay or the insurance company doesn’t provide its services. It is clearly not her fault. A lawyer would be helpful if she needs money to repair her car or to pay the hospital

can she get an attorney…sure. But he’s going to take 1/3 of whatever she has coming on her own. Geico is actually a very fair and easy to deal with insurance company.

Here’s what you do: have your mom go to a chiropractor and ask him to do a range of motion test. If she needs treatments start getting them (look for someone that accepts her insurance, just in case). Geico will research the police reports and chiropractor’s assessment. They’ll send an adjustor to estimate the damage to the car and they’ll cut you a check. You’ll probably also receive a call from them offering to write you a check for personal damages, as long as you sign a waiver releasing your right to pursue further damages in civil court. If the amount looks good to you, and you don’t think you’ll have any lasting health problems, take the check.
BTW, find a good massage therapist that does trigger point therapy and myofascial release. They’ll know how to best treat any muscular trauma.
