My husband was making a left hand turn in his work truck and was rear-ended by another vehicle, which was then rear ended by another vehicle. The first vehicle to hit my husband said there was smoke in the air so he suddenly couldn’t see. The police sent my husband on his way right away as it was obviously not his fault. This was two years ago. Now he just received a court summons from the first vehicles court/lawyer that he is sueing my husband, my husband employer, the second cars driver and his employer. The person giving the summons said to give it to his insurance company within 20 days. But, it wasn’t my husbands fault and it wasn’t my husbands vehicle, it was his work vehicle. Not sure what to do. If he doesn’t respond he is considered guilty and will be charged to pay the 0,000 they want.
My husband was not given a ticket and his work truck was brand new and insured.

I was rear ended at a red light while driving my girlfriends car. I’m excluded from her policy. It’s the other drivers fault. My neck and bAck hurt. We filed a claim with the insurance company and they want us to do a recording statement saying we agree I’m not under the coverAge. Should I get a lawyer before I agree to that? Just don’t want to jeopardize my car not getting fixed. They had liability and barely speak English.

HELP!!! I was in an auto accident in December 1, 2008. My upper back and neck were seriously injured, although the pain was not felt untill 3+ hours after the accident. Since then I have seen several doctors including : orthopedics, neurologist, chiropractor, and pain management specialist. The pain management doctor diagnosed me with Facet Joint Syndrome and Myofascial Syndrome. He assigned me 3% permanent disabilty in my neck, and also put me on 6 rescriction such as weight limit and work activity etc….. I have been on at least 10 different medications for this. The most recent that have been some what helping are tramadol 50mg 4x a day and soma compound 2x a day. I have been to the ER 2x because the pain was so unbearable. Xrays were taken 2/09 and 9/09. The ones taken in 2/09 showed a possible vertebrae fracture. There was also an MRI taken 3/09 and they said they could not see any fracture on the vertebrae. On the MRI to me it looked like the discs were slightly bulged into the spinal cord but no enough for the radiologist to say anything. He did say there was a mild straightening of the cervical spine which is due to muscle spasms. We do have a lawyer for this as the accident was 100% the other parties fault and also because I have not been able to work for more than 2 months without being in total agony. As some points it gets to a point where the pain killers don’t touch it. The pain has gotten worse over time and it is now not only in my neck but in my upper back and it seems as time goes on it begins to go farther and farther down my back. Is it possible that the doctor has wrongfully diagnosed me? If so what do you think it could be? Also the lawyer stated that the insurance company is going to want some kind of proof that there is a problem in my back. What kind of medical images would show what is going on in my back? Should I get another MRI because the one that we have no was taken so long ago and the new one could show something that was no visible at that time but has no progressed to a point where it is visible. Also what about a CT/PET scan? Would either one of those help? Please anyone any kind of input. I am currently taking tramadol now. I have seen bone doctors but not specifally a spinal doctor. I guess that will be my next step. I talked to my doctor today and they ordered the MRI and hopefully that will show something. I will try to load some pics of my MRI on here and see what people have to say.

I was in a car accident I went to physical thearpy for about 5 months and now I am waiting on my the insurance company to mail my laywer a check how long doest that take. Also if u go to the doctor for 5 months what can u expect.

I was in a minor car accident 3 yrs ago that was my fault. The police were called and a report was filed. At the time the report was filed no one claimed they were hurt, there was only minor damage to our vehicles. My insurance company paid to get his vehicle fixed. Now I’m being sued for emotional damages and loss of wages. Shouldn’t my insurance company handle this? I don’t have alot of money and am just barely scraping by so I can’t afford to pay them and can’t afford a lawyer. What do I do?

I was in a car accident in 05. It’s been five years now. Just yesterday I accepted a ,000 dollar settlement. My medical bills are several times that amount. There is no way I can pay them off. After five years of court date after court date.. depositions.. paper filing and two lawyers. I’m sick of it. And even though I will have to live with my injuries for the rest of my life.. I’m sick of fighting and want to put this behind me. So I accepted. My lawyers told me in the beginning to expect 0,000 or more due to my injuries and the nature of the accident. But the case got more and more twisted as time went on and now the insurance company just wants to take me to court.. where I could walk away with nothing.

This is my question. . I kind of asked my lawyer this. He said that the only bill that I HAD to pay from the settlement was to a hospital due to a lien? Then I would be down near ,000.

Anyways. I’m twenty-one years old. And don’t see how I am ever going to get these bills paid. My question is:

Can I spend the money and then file for bankruptcy? Or would that make me ineligible?

I want to use the money for schooling and to fix up my parents house. I don’t think it’s wrong of me to do such a thing. I have suffered for five years now with major back injuries and severe PTSD. I deserve to use that money how I please.. right?

Let me edit something. Before I ever looked into a lawyer the insurance company offered me ,000 dollars. I then began to look for a lawyer. When I found one and retained him. It was in the contract that his cut would not leave me with anything less than ,000 dollars. So he is actually only going to get ,000 dollars from the settlement. The lein from one of the hospitals is ,000 dollars. That leaves me with a check for ,000 dollars. My question is.. if I spend the money can I file for bankruptcy? I haven’t signed the papers yet. The problem with this whole case was that my lawyer hasn’t been able to prove that the farmer was negligent. His cows got out of their pasture and .. in a vehicle.. I hit one. It came through the windshield and smothered me. Most of my bills are for PTSD.. which i’ve been told is hard to sell to a jury.

I was involved in a car accident in May ‘07. I didn’t have insurance and I still do not (I live in Wisconsin and it is not required by law to have auto insurance). I gave the woman all of my information and I received a phone call from her insurance company that week as she went to the hospital. I hit her from a complete stop almost immediately as I put my foot on the gas (in my opinion, nothing that would need hospitalization). She had some damage to her bumper. After hearing from her insurance company, they told me they would call with further information. I have heard nothing from them until today (October 22), via a letter in which they are asking for collections for damages. It’s 5 months later! Can someone actually do this and what can I do?? I’m 23, I don’t have a lot of money and am pretty broke right now. I emailed a few attorneys asking them the same question, but I wanted to get some answers from anyone who has been through the same situation.

In 2008 my friend was driving and I was in the back seat. Their was a brown out on the street and the traffic light was flashing red. She did not stop and ran the light. She T-boned a truck and we spun out and she totaled her car. I hit my head very hard and was actually knocked unconcous temporarily. We were sent to the hospital ( I was sent with a neck brace on a stretcher ) We were at the hospital for hours and they put me through a cat scan. They sent me home with the brace and gave me 2 tylonols. Over the past year and a half the pain in my neck has been getting worse and has affected my work and my sleep. My primary care has reffered me to see a physical therapist. I have not been able to seek further medical help because I work full time. The other reason being that my friend’s insurance company wants me to pay out of pocket and then be reimburced for the expences while "in treatment" I unfortunately, don’t have that kind of money. The claims adjuster has outright neglected my phone calls and now the debt collectors have sent my debt to a lawyer. I haven’t even been able to see all of my collective expences so far because no one will give me a straight answer on what I owe.

What do I do now?
The claims adjuster for my friends insurance company just sent me a settlement paper. with a $$ amount on it. With nothing to back up the amount.
She never discussed it with me and since she sent the paperwork the adjuster still won’t return my calls.

The debt has already gone on my credit. and I want it removed.
