ok, we were in a car accident couple days ago.We were in a busy road and she was going to turn into the lot and i was coming down on the road and she turned and i hit her.I had no way of stopping because i was to close and was going on 40.We took all the info and she had a heart problem so they called the ambulance for her.The officer at the scene told me that she was at fault because she should have waited until u went by.So i called her insurance company and guess what no insurance.I called her to tell her that and she said that i am at fault and she says that she has hired a lawyer to sue me.Can she do that?What can i do?please any advice would be great.We still don’t have the police report ,because it takes like 5 days.But i am 100% sure shes at fault.

My mom was in a accident last year, and the other driver was at fault. She has a medical bill of about ,000. A car pulled out in front of her and she hit the side head on. Her leg was badly bruised by the part under the steering wheel, and she had a bruised lung which made her asphyxiate. This only worsened her already bad Knees and fluid problems. She was in the ICU for about 4 days. She is overweight so it made it harder for her to recover. Now, she can hardly walk, but she does. And, it has made it alot harder on our family by having to help her so much. Oh yeah, when she got out of the hospital she missed about 3 weeks from work, and now sleeps with a breathing machine. They suied the driver and got ,000, which might have to all go to the med bill if we can’t lower it. But, the boy who hit her was at work at the time running deliveries, when he is actually to young to be. So, they are also suing the insurance company that ownes the place where he works. What I really want to know is how much do you think my mom can get for her pain and suffering if she takes them to court.

p.s The insurance company has had plenty of time to come to an agreement with my moms lawyer but has yet to make a decision so we have now sent a letter stating that is they don’t reply then we will take them to court

My wife and I were in a car accident about 3 months ago. We had just rented a car from the airport, and not even 2 hours later, we were t-boned on the highway. I was going 55 and the other driver didn’t bother slowing down, failed to turn on their blinker, and carelessly turned right into my wife and I at about 40-45 mph (on my side, the driver side). My wife and I were taken to the hospital, where we had to stay for about 6 hours as they kept her hooked up to a monitor to keep tabs on our unborn child.

All my wife had was bruised ribs, but the mental part is what is bothering her. She doesn’t like getting into cars anymore, is always startled whenever we are driving past intersections, and has been worried to death for the last 3 months that there will be something wrong with our daughter.

The fact that both of us walked away almost unscathed is amazing, but mentally my wife is a wreck. The insurance company of the party that was at fault was quick about trying to get us to settle right away. They offered to pay our medical bills and to give my wife and I 0 each, for a total of 00.

Our primary concern is for our baby, which is due in the next couple of weeks. But as long as everything is fine with our daughter (and we pray that she will be okay), can we or will we be able to get more money from the insurance company, or should we just settle for the 00 as long as everything is ok with our daughter.

My wife seems to think we can get a considerable amount of money for her mental anguish and fear that our baby would come out sick and/or unhealthy for the last 3 months. I think we should just settle.

So my question is, with all the suffering (mentally) my wife has had, can we get a decent ammount of money if we decide to hire a lawyer, or would it be better just to settle and take the 00 after our baby is born and everything is alright with her? Would it even be worth it to hire a lawyer? Keep in mind that the person who hit us were 100% at fault and my wife was 6 months pregnant at the time of the accident. We have not, however, been to the hospital since the wreck and we haven’t started a paper trail of any kind. Thank you to all that help! Answers as soon as possible would be great!

Make a long story short! I was in a car accident in September 2009. I had some pretty nasty injuries. I hired a lawyer right off the back that my family member referred me too. She said he did well by her so I retained him. Anyways….I finished therapy and my package went in to the insurance company by December. Months went by and no response to the insurance company. My lawyer became more and more evasive. Recently I wrote him a letter stating that I was unhappy and I was seriously considering moving on. He called me back right away and stated that my settlement offer came and the insurance only offered ,000. I asked him when did it come in and he refused to tell me. Now…the Man who hit me was driving a rental car and he was smart and purchased the rentals insurance and didnt use his own. The Max on his policy is ,000. I told my lawyer that he needs to aask for the ask and negotiate my medical expenses with the Doctors who treated me. My Med Bills are ,000 and these are his affiliates. I made it clear to my lawyer that he should negotiate my bills and ask the insurance company for the Max on the policy. He toldme that the insurance company said they will not pay a cent more. Weeks later I wrote another letter and he called me back and said he got in touch with the man who hit me and forced him to give him his actual insurance information (for his own car). My lawyer said that he is going to file a law suit on his insurance company. I thought to myself…how is he going to do that. This man hit me with a rental not his own car so how does his insurance company have anything to do with that? The man lives in California I live in Virgina. The man was his visiting on business. My gut is tellling me to run from this laywer. Late in the game like this I don’t think its wise for me to get another lawyer (more fees associated), plus in VA my lawyer could put a lien on my case for all the work he’s done.. I just think I need to kinda force him to settle and stop playing with me. Someone who is knowledgable…please help! I’m considering going to a legal clinic. I just don’t believe my lawyer could sue the guys insurance company when he used a rental and purchased rental insurance and didn’t use his own. Should I write my lawyer a very firm letter or just report him to the bar Assc. for failing to communicate, and failure to report my settlement came through? Help…I’m a college student and unemployed. All these medical bills could compromise my credit score, plus I want my money. This is all draining and ridiculous.

a week ago i was in a car accident. i was @ a light and mine turned green, so obviously i started driving. a semi ran his red light the same time i took off and he ended up hitting my car! i went to the hospital, cause my neck hurt and i have some issues now with my eyesight and hearing. i got the police report the other day and it states that the driver of the semi addmitted to having faulty breaks. his rear air breaks were out and he addmitted running the red light. my dad has talked to my insurance company, but i havent talked to either of the insurance companies. im only 19 and i really am not sure what to do, cus my car is now totalled and you have to be 25 to have a rental car and im having to walk to work now. who should a talk to? should i go ahead and talk to an attorney or just file a claim with the other guys insurance??? please help!!

My two adult sons (ages 27 & 24)got into a car accident 4 days ago. A woman in a new jag made an illegal left turn and they hit her and she in turn hit another car. My sons were shaken up and were taken to the hospital by ambulance. The lady in the jag admitted to the police on the scene it was her fault, and she refused medical treatment although she was bleeding on your arm. The hosptial checked out, gave them xrays and released them. Thankfully they are OK. The next day I get a call in my house stating that the "insurance company" doctor needs them to come in asap to get a check up. They scheduled an appt for them. Last night they got a call from another man stating he "worked for a doctor at the hosptial that treated them" and he needs them to come in today asap. He said he can send a car to pick them up. I called my sons (they don’t live with me but still use my address and phone number). Now they are confused as to what to do. I asked a lawyer friend of mine and he said that these people are trying to get my kids to go to their doctors so that they can charge the insurance company large sums of money. What do you think? We live in New York City. My sons have their cars insured under their dad’s insurance and he lives in CT. My son’s car (a small 2 door Honda) was totaled. Are these people just trying to make some money?

About 15yrs ago i was involved in a car accident driving another persons car .(single car accident). Anyway, The insurance company sued me for this car And judgment was entered.I didn’t pay now lawyer for insurance company has a suspension on my license!! Is that legal in virginia? are there any laws protecting me?????

A week ago Sunday I was involved in a car accident in Myrtle Beach. I rear ended a girl in front of me due to her slamming on brakes because two cars in front of her slammed on brakes. (In my car, it was just me and my boyfriend. In the car I ran into, she had three passengers.) After the accident, everyone established that they were absolutely fine. They even told the cop that. Yesterday, my insurance company contacted me to let me know that she turned the incident into her insurance company and two or three of them in her car got attorneys for injuries. So.. what I would like to know is what is going to happen? I believe that means they are going to try and sue my insurance/myself. Has anyone ever been in this situation before? I’m scared and feel very heartbroken. Her car barely had any damage and mine took most of the damage after I had just gotten it painted. Should I get a lawyer? Because none of them were really hurt to have injuries. After the accident, the people in the girl’s car I hit were all standing outside of her car and laughing, having conversation with my boyfriend, so I’m 100% that they were all fine and just want to try and get money by getting attorneys. (My luck :/) Please give me any information or tips that you believe will be helpful.

hi. my case just got closed. i was a passenger in my friends’ car on June 4th, 2008 when she got rear ended. i got whiplash, my neck was straightened out (instead of being naturally curved) and i had bad headaches. n my neck has tender spots in it. i got treated for it. so my lawyer finally closed our case (i’m guessing within the last week). well my insurance company said i had to have a mandatory final evaluation w/ a chiropractor they chose. i was in another accident on sept 2, 2008. it was nowhere as severe. the results were never discussed w/ me. the chiro asked me if i’d been in any other accident and i had to tell him (i’d be screwed if i lied right? since it’s been reported). like i said our case is settled. is it possible that they can go back and change stuff?? what can happen? am i screwed? i was not back to normal after my treatment from the first accident
