How long does it take for an attorney to negotiate medical bills for an auto accident case?

My mom was involved in an auto accident in Dec.08. She was pinned between 2 cars and had severe permanent injuries. The other driver was drunk and uninsured. When we signed the retainer with the lawyer we specifically stated that he will only get his 1/3 AFTER all bills has been taken care of. We agreed that he will uses the 20k medical settlement offeree by our insurance to negogiate with medical providers while the remaining 100k of injury settlement will be split between the 2 of us. however, as soon as we signed the settlement release he took his portion right away(,333.00) and left us with (66,……,) saying since medical bills exceeded over 200k there might be a chance that we have to use our part of the settlement to pay for medical providers. It has been about 27 months and we both has gotten our part of the 100k but the separate 20k is still in his hands saying he is still negotiating. Does it usually take this long? is it possible he’s also keeping that portion and ignoring our debt to the medical providers? We are still constantly receiving collection letters. What would happen if it continues to go on unpaid?

I was in a car accident and have injuries but chiropractor wants to release me, what do I do?

I was rear ended yielding to turn right at an intersection by someone who wasn’t paying attention and when I was hit, my body was turned left to see if I could go out onto the oncoming traffic. Initially I was in shock, 1st accident, so I didnt know what to think. His car had little damager and my bumper was the only thing damaged. Called my mom and she told me to call the police and get his info and police report. Did that and went to work.

While at work, noticed I was having difficulty standing and experienced pain and stiffness in my neck. Left work early, took meds and went to sleep. Woke up next morning sore, my mom told me to go to Chiropractor and he told me I had a pinch nerve in my neck which caused the stiffness there and pain in my lower back. He set me up on a 5 week treatment and sent me to visit with a lawyer. The lawyer told me since there was little damage to my car that they probably wouldn’t be necessary. I told my chiropractor and he said he would release me VERY soon since my damages were less than 00. Can he do that? What happens now? I’m still in pain from this accident? Will I have to pay the Chiropractor out my own pocket if I seek my 5 week therapy or what happens?

Total damages to my car were roughly 0..

How much settlement money for a car accident?

My mom was in a accident last year, and the other driver was at fault. She has a medical bill of about ,000. A car pulled out in front of her and she hit the side head on. Her leg was badly bruised by the part under the steering wheel, and she had a bruised lung which made her asphyxiate. This only worsened her already bad Knees and fluid problems. She was in the ICU for about 4 days. She is overweight so it made it harder for her to recover. Now, she can hardly walk, but she does. And, it has made it alot harder on our family by having to help her so much. Oh yeah, when she got out of the hospital she missed about 3 weeks from work, and now sleeps with a breathing machine. They suied the driver and got ,000, which might have to all go to the med bill if we can’t lower it. But, the boy who hit her was at work at the time running deliveries, when he is actually to young to be. So, they are also suing the insurance company that ownes the place where he works. What I really want to know is how much do you think my mom can get for her pain and suffering if she takes them to court.

p.s The insurance company has had plenty of time to come to an agreement with my moms lawyer but has yet to make a decision so we have now sent a letter stating that is they don’t reply then we will take them to court

Can I be sued for a car accident 5 months ago?

I was in a car accident with my friend 5 months. I take full resposibility. We were laughing and joking and when I went out from the stop sign ( I stopped and looked once, but didn’t look again. stupid move, I know), I got hit on my door and ended up breaking my pelvis in 3 places, sprained my wrist, and my hip and pelvis disconnected. They had to reattach it with a metal rod. The driver in the other car was not hurt at all and did not go to the hospital. I was charged with "failure to yield the right of way" and had to go to drivers school. I just want to move on! I pay for my mistake and beat myself up about it everyday. I feel so guilty and this isn’t helping. This is money coming out of my mom’s pocket and because of my injuries, I can’t get a job and help her out. Can they sue me or make a claim? They already tried to claim on their insurance, but they didn’t get any money because their insurance refused for some reason. Do they have a valid lawsuit? Can I hire a lawyer or something?

what is the movie about a boy with memory loss?

I have tried so hard to find this answer…what is the movie about a boy that has memory loss after his mother dies of a motor vehicle accident…he lives in a orphanage or a mental institution and he meets a girl there and they fall in love and as the movie goes on he starts to remember things about his past….he has friends there and they have a like hang out place in an attic or something and they are not supposed to be up there and they kid in the wheelchair gets hurt or something but, at the end of the move after he remembers what happened to his mom they move him to a new place and the last scene of the move is of the girlfriend coming to see him and knocks on the door of his new room and he incites her and he remembers who she is after all he has been through

Accident and ticket (very specific circumstances). What should I do? Do I contact an attorney?

I was returning home at 12 in the morning, with my friend. I was driving his sports coupe (on the left lane) behind a pickup-truck driven by what looked like teenaged kids.
The truck was not being driven properly, slowing abruptly, speeding, etc, so I moved to the right lane and continued moving in order to avoid it. Then the truck side swiped the car and the rear wheel, rear fender and the driver side door were smashed.
As it had to happen, one of the kid’s mother was an officer in that city. I think the kid’s mom (officer) arrived with another officer at the scene. The other officer asked for my license and my friend’s license. Meanwhile I had called 911 and a third officer arrived.
The third officer first interacted with the other officers and the kids.

Then the third officer asked me to follow with my eyeballs his pen (left to right and back), to make sure I was not drunk, etc.

I was cited for two traffic violations. The charging officer told me that he heard from witnesses that I was changing lanes abruptly and did not control my speed. I told him that I was driving in my lane.

Finally he told me that my driver’s license is lost. He also told that my friends’ license is also lost.

What should be the best course of action now? I have a clean driving history and drive fairly defensively.

Legal Experts: In US civil trial, can a witness invoke his 5th Amendent right…?

in order to avert incriminating the defendant, per se?

For example, if Counsel for the plaintiff is questioning the friend (under subpoena) of a a driver suspected of drunk driving who was clearly liable for a horrific motor vehicle accident to the plainfiff whom sustained permanent damages, can this "friend" of the defendant invoke the 5th if asked if the Defendant had been drinking in order to avert the Defendant’s incrimination? NB, in this scenario a field sobriety test was performed and the Defendant passed, thus no breathalyzer was peformed.

death settlement from car accident?

My brother was killed in a car accident sometime ago. I know that when he died his father got some settlement money along with family on his father’s side as well. My mother got none. She did not have custody of him, but he wasn’t living with his father at the time of his death either. I am in contact with his father today, but when ever I am around him I feel funny. I don’t care about the money, I am just curious because not long after my brother died, my mom died, and my step dad and his wife out of no where were trying to push me to get a lawyer for my mom’s death, and they wanted to be part of it. I told them I didn’t want to do that, and they backed off. I know that they were trying to some how get money out of my mom’s death and ever since I have felt funny around them. I am asking about my brother, because I want to know if they did something sneaky.

my mother was involved in a car accident?

Last week my mom was injured in a car accident going through an intersection. Another woman ran a stop sign and dragged my mom’s car into some sort of electrical box or telephone box on someone’s lawn. The police clearly stated my mother wasn’t at fault…etc. SHe has a severly bruised sternum, knee, arm and cheek bone. She was rushed to the hospital..no broken bones thank goodness. My question is does she need to seek a lawyer to fight for any kind of money or will the other insurance company (the woman at fault) pay her? The woman has Geico, and I’ve heard some bad reports about them not paying for claims and what not. So, will my mom need to get a lawyer?
