I have a big problem and I really need your input on it. Last year, in August, I got in a car accident. A woman hit the red light and hit me. But we were both okay. My sister was in the back seat. After my sister checked on me, she went and checked on the woman, and the woman kept repeating this "I don’t know what I was doing, I don’t know what I was thinking.." and crying at the same time.
Unfortunately, my mom had just left the country to and her insurance was expired for 2-3 months. I was unaware. (It was my mom’s car) I wasn’t insured, but the woman was. When the cops arrived at the scene, I explained what happened. The woman played dead, even the cop knew it and told me. He wrote down in his report that it was a "No fault". He couldn’t take sides. I was 17 seventeen at the time of the accident by the way, But I had my license. So, my brother paid for the damages to my mom’s car, about 0 for the bumper. Her car wasn’t badly damaged either (but supposedly the damage was 17,000).
A few months later I recieved a letter from her insurance company, All State, and they basically just told me that they are going to investigate the details surrounding the accident and if their investigation points to me, I would have to pay the cost since I dont have insurance. Anyhow, I didn’t hear from them. Two days ago, my brother calls me from Michigan ( I moved outta the state to Utah for college) explainign to me I recieved a letter from a "Collection Agency", and they want me to pay ,000!!!! (She was speeding and hit me!) They said they are gonna put it on my credit??? Can a 17 year old even have a credit? I’m not even 18 yet, I will be On February 20, 2010. The accident was in August, 2009.
Should I be speaking directly to teh Insurance company or the collection agency? Should I geta lawyer, even though I’m broke as hell. I know I can be appointed one, but how’s that gonna work? The accident was in Michigan.. I swear she hit me,a nd she knows it. But the cops said it was a no-fault. So how can they make me pay when they can’t prove that it was my fault.
For the record, my driving record is clean and I have never been in an accident or anything. I don’t want this to affectmy credit. Please, tell em what I’m supposed to do because I ahve no clue. I can’t have this affect me. If it was my fault I would have admitted it, but I will not admit to something I did not to.
** I called the collection agency in January 2010, and they said if I pay now I can pay only 20,000. This is total BS.
