    This changes based on so many factors that it is impossible to answer here.

    Talk to your insurance company, if you even have one.

      You can get your actual damages and it will take as long as it takes. And yes the lawyer is going to get some amount from 33-50%.

          You apparently don’t even see why the question is meaningless. If you hire a lawyer to do something for you, the lawyer gets paid what you agreed to pay. Regarding accidents, there is no law establishing who gets paid what from whom after every accident. Nor is there some standard time frame. The question of who is at fault for the injuries suffered by others can be decided in a heartbeat or it could take years to decide that. Once the question of who has done what wrong is answered, only then do we get into the question of who pays whom and how much and why.
