I had a car accident few years ago. Last month my attorney and I finally made a settlement with opponent’s insurance company. Now, this week I got a phone call from my lawyer saying that I need to pay the hospital bills out of my settlement. My hospital bills include chiropractic bills (for 4-6months), orthopedic surgeon bills (one time consultation), MRI bills,etc. When I receive a settlement check from my lawyer, my lawyer already deducted his share of 30%, other legal fees, and all the consultation fees except the chiropractic office visit fees. He’s saying that this chiropractic office didn’t get his money from the insurance company, and now wants to collect his bills thru us. I don’t understand why this happened and why they asking me to pay the bills. If I need to pay this bill, that leaves me no money in the settlement fee.The attorney already took his share (33%+other legal fees). I’m very confused and I already spent all money to pay off my old bills. Please help me.

Unfortunately, the same thing happened to my husband. It took him five years to get the settlement and it didn’t even cover the medical bills. Unless your policy covers medical bills separate from the settlement, there’s nothing you can do.

As long as you maintained contiguous and coterminous medical insurance through that whole period, you should file all of the medical expenses through your insurance and use the settlement to pay the deductibles. Unless I’m missing something, you should fire your attorney.
