Best information and tips about injury claim car accident, automobile accident lawyers and personal injuries claim
I was in a car accident december 20th and got injured. My auto insurance policy said they cover up to 15,000$ in injuries for this case. I have spent on medical bills etc…already 14,000$. If I go over 15,000$, am I going to lose money from my settlement? I asked my lawyer and she said I might and she will call me and get back to me, but my lawyer is always busy and never calls me back, I’ve tried getting in contact with her for the past week and she is always too busy. So does anyone know if i will lose money off my settlement?

I think you’re mixing apples and oranges here.
You say YOUR auto insurance covers $15,000 in medical bills. It’s an odd amount for medical payments coverage. Since you’ve got a lawyer, it sounds like someone ELSE caused the accident.
If the OTHER person’s coverage is $15,000, that’s the MOST they pay out, for EVERYTHING. They will NEVER pay out more than the policy limit.
It’s not medical bills PLUS. It’s $15,000 max.
So, you probably need to clarify:
WHO was at fault?
WHOSE policy has a $15K limit, for WHICH coverage? Because I don’t think it’s YOUR insurance.
And if it IS the other guy’s insurance, then $15K really IS all they pay out. Your lawyer gets 1/3 off the top . . . so YOU will end up not getting enough to pay off your medical bills.
The alternative, is to NOT settle, and get a judgement in court, in which case your lawyer gets 40% of the total. The insurance STILL pays $15,000, your lawyer takes out her 40% of the total from THAT, and you get even LESS money from the insurance – and then you have to try to convince them to pay you the rest themselves.

If the company you are going after agreed to pay you $15,000 then anything over that comes out of your pocket. However, if you are still in the process of suing then you should be able to ask for a larger settlement as a result of newly incurred expenses. I think we may be missing something in the details here but based on the information you posted that the best answer I can offer you.
Good luck.
